Terms of Service

These Terms of Service ("Terms") apply to the website design, hosting and marketing services provided by BookedOut ("BookedOut", "we", "us"), based in Los Angeles, California. By requesting a free homepage sample, paying for a build or subscribing to a monthly plan, you ("Client", "you") agree to these Terms.
1. Services
We build websites for small and local businesses, including online booking and contact forms, and offer monthly plans for hosting, edits, search engine optimization and advertising management as described on our pricing section.
2. Free sample
We prepare a sample homepage for your business at no charge before you pay anything. You have no obligation to purchase. Samples that are not purchased may be taken offline.
3. Fees and payment
You pay only after you approve your free homepage sample. The build fee is $500 ($750 for website only, with no monthly plan), charged once together with your first month. Monthly plans (Starter $29, Growth $99, Pro $249 per month) are billed in advance each month and renew automatically until canceled. Payments are processed securely by our payment processor; we do not store your full card details. Prices are in US dollars and may change with 30 days' notice by email.
4. Cancellation and refunds
You may cancel a monthly plan at any time; cancellation takes effect at the end of the current billing month. Refunds are governed by our Refund & Cancellation Policy.
5. Your content
You are responsible for the business information, photos, logos and text you provide, and you confirm you have the right to use them. You grant us permission to use that content to build and operate your site.
6. Ownership
Your business name, logo and content remain yours. Once the build fee is paid, you may use the website design for your business. If you cancel, we can provide a copy of your site's content on request.
7. Third-party services
Your site may rely on third-party services such as domain registrars, hosting providers, Google Business Profile and Google Ads. Their own terms apply, and advertising spend on the Pro plan is paid by you directly to Google.
8. Results
We work to improve your online visibility and bookings, but we do not guarantee specific search rankings, traffic, leads or revenue.
9. Acceptable use
You may not use a site we build for unlawful, misleading or harmful purposes. We may suspend service for violations of this section or for non-payment.
10. Limitation of liability
To the extent permitted by law, BookedOut's total liability for any claim relating to our services is limited to the amount you paid us in the three months before the claim. We are not liable for indirect or consequential damages, including lost profits.
11. Governing law
These Terms are governed by the laws of the State of California.
12. Changes
We may update these Terms from time to time. We'll post the new version on this page and update the date above.
